Unpacking The Foundations and Legal Challenges of Israel

Currently the Whose Land? series comprises two parts.

Whose land? Part 1

Part One is entitled Foundations and focuses on the historic and legal foundations that led to the establishment of the modern State of Israel in 1948.

In 1917 the British government pledged to facilitate the establishment of a Jewish National Home in Palestine in the historic document known as the Balfour Declaration.  Following the end of World War One and the Paris Peace Conference of 1919, the San Remo Conference of 1920 effectively raised the Balfour Declaration to the level of an international treaty through the British Mandate for Palestine.  The Mandate recognised the historic Jewish connection to the land that was then known as Palestine, and their right to re-constitute what had been their National Home.  This right was unanimously endorsed by all 51 nations of the League of Nations and later carried through into Article 80 of the United Nations Charter, and is therefore binding in International Law to this day.

The fact that Great Britain violated the terms of its Mandate over Palestine on almost every single level – especially through the White Paper of 1939 – does not change those legal rights for the Jewish people or the re-established nation of Israel.

Whose Land? Part 2

Part Two begins with Israel’s War of Independence in 1948 and focuses on the illegality of the Arab invasion and the subsequent annexation of Israel’s historic heartland of Judea and Samaria – and its ancient capital city of Jerusalem – by Jordan. Our panel of international lawyers assert that Jordan’s occupation of the territory it renamed as ‘the West Bank’ had no legal basis whatsoever.  Israel recaptured this entire territory in the defensive Six Day War of 1967.

In Part Two – entitled The Law of Occupation and the Status of Jerusalem – our team of international lawyers, using established principles of international law that apply to all other nations, scrutinise widely used terms such as ‘Occupied Palestinian Territory’ and ‘Illegal Settlements’.  Do these terms have any legal basis, or are they simply anti-Israel propaganda?

And what about Israel’s historic capital city – Jerusalem?  Territorially, the Old City is at the very heart of the conflict.   What is behind the Palestinian claim to Jerusalem?  Why do organisations like UNESCO refuse to recognise the verifiable historic connection of the Jewish people to Jerusalem, but only an exclusive Islamic connection?  In December 2016, during the final days of the Obama Administration in the White House, the American President allowed the UN Security Council to pass Resolution 2334.  The Resolution declared that the Jewish presence in its historic heartland and its ancient capital city to be a “Flagrant Violation of International Law.”  Is it?  Our team of international lawyers, together with three former Israeli Ambassadors to the UN expose it for the lie that it is – one of the many, many lies levelled against the Jewish State.

A third part to Whose Land? is in the pipeline, and some filming has been done.  However further production is in abeyance until all the necessary funding is in place.

A retired British Army Officer, Kemp served in the Cabinet Office from 2001 to 2006 as Chairman of the Joint Intelligence Committee, advising the COBRA crisis management group. He was Commander of British Forces in Afghanistan from 2003 to 2004 and has testified before a UN Fact Finding Mission on the Gaza conflict. Kemp is frequently interviewed by the BBC and other media on security and intelligence issues.
